Scott Leimgruber works with in-house counsel, business owners, project managers, and executives to provide legal expertise primarily focused on construction law.  His extensive experience in commercial construction management and detailed understanding of his clients’ issues empower Scott to bring effective and efficient resolution to matters involving construction claims, public and private works disputes, surety bond claims, Miller Act claims, delay claims, and construction defect litigation.  Clients include general contractors and specialty subcontractors.

Scott was a project superintendent for an Engineering News-Record (ENR) Top 10 contractor for nine years prior to attending law school and his arrival at Finch, Thornton & Baird, LLP.  During this time, Scott’s duties included:

  • Managing multi-million-dollar commercial projects through all phases of construction
  • Developing and maintain construction schedules
  • Directing site progress and resolving project issues and disputes
  • Negotiating change orders with owners and subcontractors
  • Preparing proposals and estimates for new work
  • Drafting and negotiating contracts with clients, design partners, and subcontractors

This unique background, hands-on skill set, and in-depth knowledge of construction operations, practices, and priorities enable Scott to get up to speed very rapidly.

DELAY, INEFFICIENCY, AND EXTRA WORK CLAIMS

Delays and disputes over liquidated damages and cost overruns are common.  Scott’s construction field experience allows him to identify key issues and prepare a strategy to best leverage the client’s position for entitlement for additional time and money — or to defend claims for the same.  Clients rely on Scott’s construction knowledge combined with his understanding of the legal requirements to aggressively pursue their interests and bring timely resolution to their issues.

PROJECT/OWNER NEGOTIATIONS OF PUBLIC AND PRIVATE PROJECTS

Construction contract disputes are inevitable.  Scott understands from his time in the field.  He also knows that how the parties handle such disputes often matters just as much as the facts at issue.  Navigating contractual dispute resolution, Public Contract Code, Government Code requirements, and evaluating the timing of claim submissions is complex and requires attention to detail.  Scott’s know-how in this challenging environment allows firm clients to remain focused on completing their projects, minimize risks, and maximize profits.

CONSTRUCTION DEFECT LITIGATION

No contractor accounts for the time and expense of having its personnel tied up in court defending construction defect claims — especially years after a project is complete.  So Scott’s ability to evaluate as-built plans and specifications, RFIs, submittals, and change orders is a valuable asset.  One that enables him to sift out alleged defects from actual owner wish-list items or design defects.  Once Scott understands the basis facts, he works seamlessly with project personnel and insurance carriers to aggressively defend against construction defect claims and pursue reasonable settlement opportunities.
