Unpaid Second Tier Subcontractor Recovers Principal, Interest and Attorneys’ Fees

The firm represented a landscape contractor, who installed new landscape and irrigation on a project for the State of California. The firm’s client was a second tier subcontractor to a subcontractor owned by the brother of the owner of the general contractor. The firm’s client was terminated at the maintenance stage of the job, and paid nothing. The firm filed suit against the two brother-owned construction firms and the payment surety of the general contractor. After discovery and proving the surety was at risk, the case settled for payment to the firm’s client of more than 150% of the principal claim.
