The firm represented the general contractor in preparing and prosecuting claims for additional payment from a local agency administering a light rail construction project. The plans and specifications detailed the type of work to be encountered and bid items to be paid for each type of work. During construction it was discovered that areas designated as one type of work were actually a more costly bid item of work. The agency disputed payment for the higher unit price because the top layer of the work was a less costly bid item, and also contended items were final pay quanitites. The firm crafted claims based on the bid item descriptions, and alternatively differing site conditions and work character changes. Through a pre-litigation mediation, the firm recovered roughly 90 percent of the claim for its client.
