The client was the general contractor for the construction of a public work of improvement. Its landscaping subcontractor filed bankruptcy and abandoned its work on the project—thus forcing the general contractor to complete the work. The firm made a demand on the subcontractor’s performance bond surety and negotiated payment by the surety for the cost to complete before suit was filed.
