Design-Build Contractor v. Design Firm

The firm’s client was the design-build contractor for a county-owned housing project in California. During the final design approval process the firm’s client discovered its design consultant failed to design a critical HVAC system to provide for smoke evacuation in the event of fire.  The firm pursued claims against the deisgn firm for the costs and delay caused by the design not meeting code and project requirements.  The matter settled after mediation on extremely favorable terms for the firm’s client.
