PRIME CONTRACTOR RECOVERS FROM SUBCONTRACTOR

The firm represented a prime contractor in a dispute regarding a local agency public works contract.  The prime contractor alleged the subcontractor’s defective work delayed the project and caused the prime contractor to incur significant rework costs.  The prime contractor filed a demand for arbitration, and the subcontractor filed a counterclaim seeking alleged unpaid contract balance and change orders.  On behalf of the prime contractor, the firm defeated a motion for summary judgment by the subcontractor and ultimately resolved the case via a settlement that resulted in a significant payment to the prime contractor.
