Melissa H. Rose

Attorney

Melissa understands that maintaining healthy business relationships is often as important — if not more so — than purely settling matters monetarily. This awareness helps Melissa calm client frustrations, minimize or mitigate disputes, and accelerate amicable settlements.

Melissa Rose works with construction company owners, project managers, claims directors, and in-house counsel.  Her practice focuses on litigation, collection remedies, labor and employment, and insurance coverage.  Melissa’s clients include general contractors and subcontractors.

Melissa brings strong analytical and writing skills to the representation of Finch, Thornton & Baird, LLP clients.  She pays close attention to the details, too. But it is Melissa’s ability to simply get along well with others that consistently engenders trust and respect in her relationships. It is a quality that has benefited Melissa both at work and in dealing with opposing counsel and other parties.

DELAY, INEFFICIENCY, AND EXTRA WORK CLAIMS

For general contractors and subcontractors, payment disputes, work delays, contract non-compliance, and unforeseen conditions are common; together they can undermine even the healthiest company.  Well versed in commonly litigated construction contract disputes, Melissa understands the facts and evidence necessary to prevail on such matters.  Melissa also understands that maintaining healthy business relationships is often as important — if not more so — than purely settling matters monetarily.  This awareness helps Melissa calm client frustrations, minimize or mitigate disputes, and accelerate amicable resolutions.

LIENS, STOP PAYMENT NOTICES, AND BOND CLAIMS

General contractors, subcontractors, and business owners understand the frustrations caused by delayed, disputed, or withheld payments — including the consequences if claims are not promptly and properly resolved.  Melissa’s tenacity and research expertise, including obtaining third-party documents when appropriate, consistently produces the case-winning support needed to weaken or disprove opposing counsel’s claims, or to strengthen the firm’s position in mediations.

PRIVATE WORKS CONSTRUCTION LITIGATION

For general contractors faced with subcontractor claims or withheld payments from owners, Melissa’s knowledge of project documentation, combined with her application of specialized laws and collection remedies, are qualities that consistently result in firm clients getting paid — or avoiding unwarranted payments.  This also contributes to more timely project closeouts.  As is usually the case, early intervention and counsel often prevents problematic situations from spinning out of control.

PUBLIC WORKS CONSTRUCTION LITIGATION

At every turn, general contractors of public works face countless strict regulations and administrative red tape.  Melissa understands these challenges and sets about zealously, but tactfully, to compel public agencies to produce vital documents through PRA or FOIA requests.  This leads to the persuasive legal leverage necessary to force parties to compromise their positions and, ultimately, leads to firm clients getting paid what they are rightfully owed.

WAGE AND HOUR DEFENSE AND LITIGATION

Whether drafting and enforcing effective policies or participating in the defense of individual or class-action lawsuits, Melissa is well-informed about the complicated, continually changing employment laws and regulations.  When disputes do occur, Melissa and our firm’s aggressive approach usually result in efficient, cost-effective dispute resolution.

CALIFORNIA AND FEDERAL OSHA DEFENSE AND COMPLIANCE

General contractors, specialty subcontractors, general business managers, and human resources executives can quickly find themselves awash with OSHA compliance issues.  As a member of our labor and employment team, Melissa provides meaningful experience to ensure clients’ health and safety documentation and training procedures are fully Cal/OSHA and federal OSHA compliant.  She also contributes to the defense of clients from citations and penalty assessments brought by Cal/OSHA and federal OSHA.
