GENERAL BUSINESS DISPUTES

Derek has considerable business education and knowledge of complex business transactions.  He is experienced in all legal aspects of business formation and practice, and has the ability to perform financial analysis for litigation.  While much of his experience includes dispute resolution without litigation, Derek has achieved positive outcomes in litigation and through alternative dispute resolution methods.

REAL ESTATE LAW

Derek began his legal career in real-estate litigation where he provided clients with cost-effective solutions to property agreements, ownership disputes, and foreclosure defenses.  Today, Derek represents business owners, developers, and residential homeowners who encounter construction issues with general contractors and subcontractors.  These include deficient construction work, failed real estate transactions, and business disputes.  Derek’s real estate law success is a result of obtaining the best outcomes for his client — whether that be through negotiation, litigation, or alternative dispute resolution.

CONSTRUCTION DEFECT LITIGATION

Winning favorable results in construction defect disputes requires specialized knowledge of construction practices and insurance coverage, combined with litigation know-how.  Derek’s experience in complex state and federal construction litigation on behalf of contractors, subcontractors, owners, and insurance companies has consistently achieved positive outcomes in even the most challenging cases.  For one notable client and homeowner, Derek and the firm secured a $400,000 settlement after a two-year dispute with an insurance company that denied any liability by prevailing on a federal court summary judgment motion.

PROPERTY DAMAGE LITIGATION

First-party and third-party insurance disputes present unique challenges all their own.  They demand specialized knowledge of insurance coverage and legal expertise to recover the optimal payment results.  Derek’s strong understanding of complicated policy exceptions and exclusions has guided the successful representation of both insurers and insureds in state and federal litigation.

PERSONAL INJURY LITIGATION

Derek’s ability to identify the facts necessary to determine responsibility and to efficiently lead expert investigations enables him to provide cost-effective resolution to personal injury claims for Finch, Thornton & Baird, LLP clients.  While early settlement in personal injury is quite often in our client’s best interest, aggressive litigation always remains an option.

DELAY, INEFFICIENCY, AND EXTRA WORK CLAIMS

Construction projects often encounter design mistakes, project inefficiencies, delays, interferences, and other unforeseen issues.  Derek’s construction law experience includes knowing what questions to ask, what information to obtain, and what legal strategies to employ.  Proactive resolution of delay and extra work claims saves Finch, Thornton & Baird, LLP clients money and gets them back to work quickly.  When litigation is necessary, he will aggressively simplify complex claims to obtain the best outcomes for our clients.
